Business Sponsored Temporary Work 457 Visa
The Temporary Business Long Stay - subclass 457 Visa is one of the most commonly used program for employers to sponsor overseas workers to work in Australia on a temporary basis to fill nominated skill positions.
With the 457 visa you are alowed to:
- work in Australia for a period of between 3 months and 4 years
- bring any eligible secondary applicants with you to Australia - secondary applicants can work full-time and study
- after entering Australia, travel in and out of Australia as many times as you want
To apply for the 457 visa, you must:
- be sponsored by an employer to fill a nominated position
- have skills, qualifications, experience and an employment backgroun which match those required for the position
- be eligible for any relevant licences or registraion required for the nominated position
- demonstrated that you are to be paid at least the minimum salary level that applies at the time a decision is made on your visa
457 Visa Process
Most 457 visas are granted on the basis of sponsorship by a Standard Business Sponsor (SBS) who can be either an Australian business or an overseas business. In such a situation, there will be three steps in the process:
- Approval of the employer as the Standard Business Sponsor
- Nomination of the visa application
- The 457 visa application
What are your obligations as a sponsored employee?
If your application for a Temporary Business Long Stay 457 Visa is approved, you must NOT:
- stop working for the employer who sponsored you
- work in a different position other than the position that was nominated in the visa applications
- work for another person or for yourself while working for your sponsor
You must notify the Australian Department of Immigration of any change in your circumstances.
If your sponsor ceases your employment, you must do one of the followings:
- find another employer who is willing to sponsor you and apply for another visa, or
- apply for another type of substantive visa, or
- leave Australia in 28 days unless your visa expires before that time
