Australian Employer Sponsored Migration - Work in Australia
The Employer Nomination Scheme (ENS) program allows Australian employers to nominate a person, who is resident overseas or who is working in Australia as a temporary resident, to fill a skilled position within the organisation.
If successful, the Employer Nomination Scheme (ENS) visa or SC 121/856 visa will allow the nominee and any accompanying family members to remain permanently in Australia.
The Employer Sponsored process has two stages:
- Business nomination - your employer must be approved by the Australian Department of Immigration (DIAC) as being a suitable employer to nominate you for permanent residency in Australia
- Visa application - you must provide evidence that you have the necessary skills and personal attributes to be employed in the nominated position
Employer Sponsored - Business nomination
The nomination stage relates to the company and the position to be filled. The nominating company must:
- be actively and lawfully operating in Australia
- have complied with immigration laws in the past
- have a sound financial record and not have an adverse business background
- have complied with workplace relations laws of the Commonwealth and any State or Territory in which it operates; and
- have a satisfactory record of training Australian staff in the business operations of the company or, in the case of a new business, the company has made satisfactory provision for future training of Australian staff
The position to be filled must:
- provide working conditions which are in accordance with Australian immigration law
- relate to an occupation on the Employer Nomination Scheme Occupations List (ENSOL)
- meet minimum salary requirements
- be a full time position and be available for minimum three years
Employer Sponsored - Visa application
You, as the visa applicant, must:
- hold an eligible temporary visa, if in Australia at the time of lodgement
- be under 45 years of age
- be a "highly skilled" person
- have Vocational English level proficiency, unless exceptional circumstances apply
- along with family members, if any, meet health and character requirements
- be eligible for any mandatory licensing, registration or professional body membership that is required of the nominated occupation
All persons over the age of 18 years are required to demonstrate Functional level of English language. If unwilling and unable to demonstrate, an additional second visa application charge will apply.
The Employer Sponsored SC121/856 Visa is a permanent visa. As a permanent resident of Australia, you and your accompanying family members, if any, are permited to remain in Australia indefinitely.
